These Terms of Service ("Terms") govern all projects, services, and engagements between KJM Dezignz ("Designer," "we," "us") and any individual or business ("Client," "you") who engages our services.
By submitting a project request, approving a quote, making a payment, or otherwise engaging KJM Dezignz, you confirm that you have read, understood, and agree to be bound by these Terms in full.
These Terms apply to all services offered by KJM Dezignz, including but not limited to web design, single-page design, full website development, logo design, brand identity, and consultation services.
KJM Dezignz reserves the right to update these Terms at any time. Continued engagement after an update constitutes acceptance of the revised Terms. The most current version is always available at this page.
All projects begin with a project request and a formal quote. The scope, deliverables, timeline, and pricing of each project will be confirmed in writing (via email or invoice) before work begins.
What is included in each project will be clearly outlined in the quote or invoice. Anything outside of that agreed scope is considered additional work and may require a separate quote.
Consultation calls via Google Meet are offered free of charge and carry no obligation. A consultation does not constitute a binding agreement to proceed with a project.
KJM Dezignz provides custom design services only. We do not use pre-made templates, stock logo designs, or unlicensed assets in client work unless expressly agreed upon in writing.
All prices are quoted and billed in US Dollars (USD). Prices are subject to change but will be locked in once a quote is formally approved by the client.
50% Deposit: A non-refundable deposit of 50% of the total project fee is required before any design work begins. Work will not commence until the deposit is received and confirmed.
Final Payment: The remaining 50% balance is due upon completion of the project and before final files are delivered. Final files, source files, and transfer of ownership will not occur until the full balance is paid.
Accepted payment methods: Zelle, Cash App, Venmo, and bank transfer. Payment details are provided on your invoice.
Late payments: If the final balance is not received within 14 days of project completion, KJM Dezignz reserves the right to withhold final file delivery and/or pause the project until payment is received.
KJM Dezignz is committed to client satisfaction. We will work with you through revisions to achieve a result you are happy with. However, because design work involves significant time and creative effort invested from the start, our refund policy is structured as follows:

Dissatisfied with results? If you are unhappy at any stage, please communicate this immediately. KJM Dezignz will make every reasonable effort to address concerns through additional revisions before a refund is considered. Refund requests based on a "change of mind" or change in business direction after work has begun are not eligible.
Requesting a refund: All refund requests must be submitted in writing to kjmdezignz@gmail.com. Approved refunds will be processed within 7–10 business days via the original payment method where possible.
KJM Dezignz includes a reasonable number of revision rounds with every project. The number of included revisions will be specified in your project quote.
What counts as a revision: Adjustments to colors, fonts, layout, sizing, text, or design direction based on feedback provided after delivery of a draft.
What is not a revision: A complete change in design concept, style direction, or brief after work has begun. If a client significantly changes the project scope or direction, this may be treated as a new project and quoted accordingly.
Feedback must be provided in a timely and consolidated manner. Please gather all feedback before responding to a draft — multiple rounds of scattered feedback may count as separate revision rounds.
If no feedback is received within 14 days of a draft being delivered, KJM Dezignz reserves the right to consider the project complete and invoice the final balance.
Estimated timelines are provided in good faith based on the agreed project scope and current workload. These are estimates, not guarantees, unless a firm deadline is explicitly agreed upon in writing.
Client-caused delays: If a project is delayed due to the client failing to provide content, feedback, approvals, or payment in a timely manner, KJM Dezignz is not responsible for missed deadlines. The project timeline will be adjusted accordingly.
Designer-caused delays: If KJM Dezignz anticipates a delay, the client will be notified as soon as possible with a revised timeline.
Rush projects (required completion in less than the standard timeline) may be subject to an additional rush fee, which will be communicated and agreed upon before work begins.
Upon receipt of full payment, the client receives full ownership of the final delivered design files. This includes the right to use, modify, reproduce, and distribute the work for any lawful purpose.
Until full payment is received, all design work, concepts, and files created by KJM Dezignz remain the intellectual property of KJM Dezignz. The client may not use, publish, or reproduce any design work until the final balance is paid in full.
Portfolio rights: KJM Dezignz reserves the right to display completed work in our portfolio, website, and social media channels unless the client requests confidentiality in writing before project completion.
Third-party assets: Any stock images, fonts, or other third-party assets used in a project must be properly licensed. KJM Dezignz will inform clients of any licensing requirements. The client is responsible for ensuring continued compliance with any asset licenses after delivery.
Source files: Source files (e.g. Adobe Illustrator, Figma, Photoshop files) are included in the delivery package unless otherwise stated. If not included in the original quote, source files may be provided for an additional fee.
KJM Dezignz treats all client information, business details, project briefs, and proprietary information shared during the engagement as confidential. This information will not be shared with third parties without the client's express consent, except where required by law.
Clients similarly agree to treat any proprietary methods, pricing structures, or unpublished work shared by KJM Dezignz as confidential and not to share, reproduce, or distribute such information.
KJM Dezignz will perform all work with professional care and skill. However, to the fullest extent permitted by applicable law, KJM Dezignz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the services provided.
KJM Dezignz's total liability to any client for any claim arising out of or related to services rendered shall not exceed the total fees paid by the client for the specific project giving rise to the claim.
KJM Dezignz does not guarantee any specific business outcomes, revenue growth, conversion rates, or search engine rankings as a result of design work delivered.
The client is responsible for ensuring all content provided to KJM Dezignz (text, images, logos, trademarks) is legally owned or licensed by the client. KJM Dezignz is not liable for any intellectual property infringement arising from client-supplied materials.
Either party may terminate a project engagement at any time by providing written notice via email.
Client termination: If the client terminates the project, any amounts paid up to the point of termination are subject to the Refund Policy outlined in Section 4. Any outstanding invoices for work completed up to the termination date remain payable.
Designer termination: KJM Dezignz reserves the right to terminate a project if the client engages in abusive, threatening, or unreasonable behavior; fails to make required payments; or significantly changes the project scope without agreement. In such cases, a full refund of any payments made will be issued minus the fair value of work completed.
Upon termination, each party will promptly return or destroy any confidential materials belonging to the other party.
KJM Dezignz values every client relationship. If you have a concern, question, or dispute regarding your project or these Terms, we strongly encourage you to reach out directly before taking any other action. Most issues can be resolved quickly through direct communication.
Governing law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
Dispute resolution: In the event of a dispute that cannot be resolved through direct communication, both parties agree to attempt mediation in good faith before pursuing any legal action.
